Civil law cases include but are not limited to contract law disputes, personal injury claims, property law disputes, employment law disputes and the like.
Civil litigation involves two private parties in dispute, i.e. the key players are the Plaintiff/ Applicant the party who initiates the legal proceedings by bringing a legal action or an application and the Defendant/ Respondent is the party against whom the lawsuit is filed. In Civil cases the plaintiff/Applicant must prove their case on a balance of probabilities.
Whilst many civil cases are resolved through settlement endeavours, whereby parties conclude an agreement without proceeding to court. Settlement agreements expedite the legal process and are cost effective. However, civil litigation and trials are necessary when parties cannot negotiate settlement and reach amicable consensus on pertinent issues.
